Welcome to Psion Community!

Psion Plc, Psion Inc and their subsidiaries and affiliated companies (“Psion”) are pleased to host the Psion community website at http:community.psion.com (“the Site”). As you interact with and contribute to the Site we need to make clear our respective rights and responsibilities in relation to it.  Psion offers the services on the Site to you subject to the terms and conditions of use (“Terms”) contained herein.  By accessing, creating or contributing to any content and in consideration for the use of the Site we provide to you, you agree to abide by these Terms.  Please read them carefully and completely before accessing, posting or creating content on this Site.

1.            Accessing the Site.

You understand that all content posted to the Site is the sole responsibility of the individual who originally posted the content.  You understand, also, that all opinions expressed by users of this Site, including those who work for Psion, are expressed strictly in their individual capacities, and not as representatives of Psion or any of its subsidiary or affiliate companies. Opinions expressed here and in any corresponding comments are the personal opinions of the original authors, not of Psion.  

You agree that Psion and its subsidiary and affiliated companies will not be liable, under any circumstances and in any way, for any errors or omissions, loss or damage of any kind incurred as a result of use of any content posted on this Site.  You agree that you must evaluate and bear all risks associated with the use of any content, including any reliance on the accuracy, completeness, or usefulness of such content.

Access to our Site is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on our Site without notice. We will not be liable if for any reason our Site is unavailable at any time or for any period.

From time to time, we may restrict access to some parts of our Site, or our entire Site, to users who have registered with us. You are responsible for ensuring that all information that you provide to us in order to register is accurate, complete and not misleading. If you inadvertently receive access to a secure area of the Site without having registered to do so, you agree to inform us as soon as possible so that we may make any necessary adjustments.

If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential, and you must not disclose it to any third party. We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our opinion you have failed to comply with any of the provisions of these Terms.

You are responsible for making all arrangements necessary for you to have access to our Site.  You are also responsible for ensuring that all persons who access our Site using the user identification that we have provided to you are aware of these Terms, and that they comply with them. 

2.            Posting to the Site.

You may post reviews, comments and other content; send communications; and submit suggestions, ideas, comments, questions, or other information (“Content”), as long as the Content is not illegal, obscene, abusive, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties, or objectionable and does not consist of or contain software viruses, political campaigning, chain letters, mass mailings, or any form of "spam." You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of any Content. You may not use the Psion name to endorse or promote any product, opinion or cause.  Representation of your personal opinions as endorsed by Psion or any of its subsidiary or affiliate companies is strictly prohibited.

By posting Content you warrant and represent that you either own or otherwise control or have licensed all of the rights to that Content, including, without limitation, all the rights necessary for you to provide, post, upload, input or submit the Content.  You agree that you will not post confidential or trade secret information of others.  You agree that you will indemnify and hold Psion and its subsidiary and affiliated companies harmless for any and all claims resulting from Content you supply. You agree that you will not knowingly and with intent to defraud provide misleading and/or false information or materials.  You represent and warrant also that the Content you supply does not violate these Terms.

If we grant you access to view any of the secure areas of the Site, you agree that you will not disclose any of the information included in that secure area to any third party without Psion’s prior written consent, including but not limited to moving or copying that information to a non secure area of the Site.

No content may be posted that is intended to promote, or commit, an illegal act.  No content may be posted with respect to the circumvention or avoidance of any digital right management (DRM), licensing control or similar system.

Unless you specify otherwise, and except as defined in Section 3 below, you agree that any and all works of authorship copyrightable by you and posted by you are submitted under the terms of an Attribution-ShareAlike Creative Commons Public License, a copy of which is available at http://creativecommons.org/licenses/by-sa/3.0/legalcode.  Under this license, which forms part of these Terms, you permit anyone to copy, distribute, display and perform your Content, royalty-free, on the condition that they credit your authorship each time they do so.  You also permit others to distribute derivative works of your Content, but only if they do so under the same Attribution-ShareAlike license that governs your Content. No information you consider confidential should be posted to this Site.

You acknowledge that Psion does not pre-screen or regularly review posted content, but that it shall have the right (though not the obligation) to move, modify or remove in its sole, arbitrary and absolute discretion any Content and, in particular, any Content that it considers to violate these Terms or the terms of any other provider or user agreements that may govern your use of the Site and our networks. If you witness any breaches of these Terms, please notify us at webmaster@psion.com

On being aware of any breaches of these Terms, Psion may ban, delete or prohibit any Content that relates to those breaches or that it judges harmful to individuals, Psion or any of its subsidiary or affiliate companies or any of our officers, servants or agents. Psion reserves the right to take whatever action it deems necessary to prevent such breaches including the following: (i) breaches Psion deems minor may result simply in receipt of a warning; or (ii) breaches Psion deems serious may result in Psion preventing further access by you to the Site. All incidents will be logged and Psion’s decision will be final in all cases. Any breaches may result in us reporting your activities (to your internet service provider, your employer or relevant authorities), to legal action being taken against you, or to both.

3.            Psion Copyright and Other Intellectual Property

All material (including without limitation photographs) published on this Site by Psion is subject to the copyright ownership of Psion Inc or its licensors and may not be reproduced in any format and in any circumstances without the prior written consent of an authorized person within Psion Inc. Users of the Site may retrieve and display the content of the Site on a computer screen, and temporarily store such content in electronic form on disk as a normal part of that retrieval and display. Permanent storage, copying or re-distribution of these pages or their contents is prohibited unless clearly indicated on the relevant section of the Site that content is available for download or reuse.

All intellectual property, including without limitation, patents, copyright, designs, trademarks (“Intellectual Property”), relating to  Psion Products and work product created in respect of such Products, including but not limited to, functional design or Product customizations, are and shall remain Psion Inc’s exclusive property or the exclusive property of Psion’s third party licensors

Psion retains the right to use any Content submitted by you, for the purposes of improving, creating,  redesigning or marketing Psion’s products and/or services without consideration or attribution to you.  Should your submission of Content result in, or in any manner lead to, the creation of a patentable innovation or other registrable Intellectual Property (i.e. - Copyright, Design, Semiconductor Topography, etc.) you agree to cooperate  with and assist Psion in registering such right, at Psion’s sole expense and to assign your rights, if any, in that registration to Psion.

4.            Trade-marks.

The trade marks, logos and service marks (“Marks”) displayed on this Site are the property of Psion or other third parties. Users are not permitted to use these Marks without the prior written consent of Psion or such third party which may own the Mark.

5.            Cookies.

A cookie is a small data file that certain websites write to your hard drive when you visit them. A cookie file can contain information such as a user ID that the site uses to track the pages you’ve visited, but the only personal information a cookie can contain is information you supply yourself. A cookie can’t read data off your hard disk or read cookie files created by other sites. Psion may use cookies to track user traffic patterns to determine the usefulness of information to our users and to see how effective our navigational structure is in helping users reach that information. Psion does not share this information or sell it to any third party.

6.            Products and Services Availability.

Because international information is provided at this Site, not all products or programs mentioned will be available in your country. Please contact your local sales representative for information as to products and services available in your country.

7.            Links to Third Party websites.

This Site may contain links to third party websites. Access to any other website linked to this Site is at the user’s own risk and Psion is not responsible for the accuracy or reliability of any information, data, opinions, advice or statements made on those websites. Psion provides these links merely as a convenience and the inclusion of such links does not imply an endorsement.

8.            General Disclaimer.

Psion assumes no responsibility for and makes no representations as to the accuracy or completeness of the information on the Site. Psion may change the programs or products or any other content mentioned at any time without notice. Mention of non-Psion products or services is for information purposes only.

ALL INFORMATION PROVIDED ON THIS SITE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED. PSION AND ITS SUPPLIERS DISCLAIM ALL WARRANTIES AND CONDITIONS EXPRESS OR IMPLIED INCLUDING, WITHOUT LIMITATION, THOSE OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT OR ARISING FROM A COURSE OF DEALING, USAGE, OR TRADE PRACTICE.

PSION AND ITS SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, CONSEQUENTIAL, OR INCIDENTAL DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE THIS SITE OR ANY PSION PRODUCT OR SERVICE.

9.            Access to Password Protected/Secure Areas.

Access to and use of password protected or secure areas of the Site is restricted to authorized users only. Unauthorized individuals attempting to access these areas of the Site may be subject to prosecution.

10.         Software License Agreement.

Any software which you download from the Site is governed in accordance with (i) the license terms accompanying the file or (ii) if no license terms accompany the file, the terms of the license agreement which accompanied the original product licensed by you which you are updating or (iii) if neither of the foregoing apply, the license terms pursuant to this End User License Agreement [link].

11.         Open Source License Notices.

Psion Products may contain software from the open source community that must be, and are, licensed under the specific license terms applicable to such software.

12.         Privacy Policy.

13.         Modification of These Terms of Use.

Psion reserves the right to change, at any time, at its sole discretion, the Terms under which use of this Site is offered.  You are responsible for regularly reviewing these Terms.  Your continued use of the Site constitutes your agreement to all such Terms.

14.         Disputes.

The use of this Site and the associated Terms of Use are governed by the laws of the Province of Ontario, excluding its conflict of laws provisions.  Any dispute arising out of or in relation to this Site shall be settled in the provincial Courts of Ontario, located in Toronto, Canada, which shall have exclusive jurisdiction.
